II. Report from Adam McFadden on the proposed legislation for Drug Free Zones. Generic Ordinance was handed out for review.

Per Crime Prevention Officers - Within the last month

521 Chili Avenue - Assault Shooting-This area has been very active with regard to crime. Around the area of 92 Ringle Street-the shot spotter picked up crime in the area 6 shots fired, located nine 45-caliber casings near 30 Thurston Road address and 5-380 caliber casings near 521 Chili avenue. Victim had minor gunshot wound to his left elbow. He was uncooperative and may be involved in gang activity.

910 Genesee Street - Subway Restaurant was robbed - Suspect –Entered through east door (from parking lot)and asked for everything they had while supposedly holding a gun in his pocket. Cashier gave suspect $300 from register. U of R cameras at the east door showed another suspect waiting for him there and they both proceeded to leave the premises to the north. Cameras in Subway were in operation as this took place. This will be further investigated.

950 Chili Avenue - Quick Fill-Attempted robbery-Suspect entered the premises and said “I am coming for money”. The clerk pushed the silent alarm. This perturbed suspect and he told clerk “you should not have done that” and pulled out a hand gun. Employee that worked there grabbed for the gun but the suspect pushed him down, then employee ran for the door and he was shot at but missed the employee. Nothing was garnered by the suspect. As a result, the suspect entered a dark blue mini-van with chrome on the back. The store’s camera captured the entire incident.

454 Chili Avenue – Criminal use of a weapon. Multiple shots were heard as a Mercedes Benz sped at a high rate of speed going down Hobart Street. Before vehicle could be pulled over one of the suspectsgot out of the vehicle. He was later apprehended by police on the porch of 69 Lozier Street and had ammunition in his pocket. Officers found a loaded Taurus PT149 handgun at 57 Lozier St. with one round in chamber and in the magazine and handgun was also stolen. Suspect lived on Alberta Street and charged accordingly, the driver was also apprehended (unclear as to what the charges will be).

162 Flanders Street - Street robbery. Delayed report –Parkridge hospital. Victim was being dropped off by a friend at 2:00 a.m. when 2 suspects approached victim in car and said “give me what you got”. Victim was pistol whipped as he tussled with suspect in the head and has minor abraisions to back and side. Victim handed over $151 in cash, AT&T cellular phone. Suspects fled westbound on Thurston Rd. Victim was taken to Parkridge Hospital by a friend.

321 Post Avenue- This arrest was for criminal possession of a weapon and possession of a controlled substance (91 grams of marijuana). A male was arrested that resided in Watertown, NY. Officers were on foot patrol and observed the suspect driving in the same area, Post Avenue several times. The officers stopped him after he ran a stop sign. The individual had a 9 mm handgun on his waist ban.

Due to the open air drug market in the City of Rochester, Adam McFadden has been working on legislation that would curtail drug sales. The legislation was drafted after the Washington, D.C. model. The tool suggested was to declare troubled areas a free drug zone. A few years ago this legislation was proposed to allow the police to use additional tools to affect a Drug Free Zone and was not received well. This legislation has been redrafted and will be put before City Council again. The legislation would allow the police department the ability to go into troubled areas where there have been open air drug dealing occurring and difficult for the police to stop this unwanted activity. As there are arrests, shootings or homicides in that area within the last six months, an area can be declared a Drug Free Zone. The police will be allowed to declare an area a Drug Free Zone. This would allow the police to indicate if persons are loitering within one-thousand feet of a certain intersection they can be arrested. The suspect can be arrested on site and a fine of $300 given to the individual and up to 30 days in jail. The idea is to not to make loitering comfortable and breed open air drug activity.

Please review e a generic copy of the legislation. This legislation is being rewritten, per Councilman, McFadden.
