Well, I just received a letter from the Southwest NSC (Carl Williamson) that on January 23, 2013, my toter was observed between the sidewalk and the curb 48 hours AFTER my scheduled pickup. The letter is dated January 23, 2013. Sorry, but I had to stop laughing before posting this. BUT my pickup day is THURSDAY! So it would be to the curb on Wednesday January 23 until possible Friday January 25, 2013 at noon. BUT MLK day was Monday January 21, so my pickup day would have been delayed one day until January 25, 2013. It was picked up this morning......Now the real ironic thing about this is that due a handicapping condition, my garbage is picked up from my yard by a City of Rochester Refuse Collector which was started in December 2012!!!! So my green rolling refuse container is NEVER curbside!! Now the last sentence says to call him at 428-7630 9a-5p Monday thru Friday. I just called at 1:30p TODAY, AND EVERYBODY IS EITHER OUT OT LUNCH OR GONE!! FIGURES!!

OK, today 2/15/13 I received from our local NSC Administrator David Hawkes my SECOND First Warning Letter that my toter was observed curbside on 2/11/13. I received my First Warning Letter in January 2013. Pickup day this week was 2/14/13 and due to a handicap, the City refuse collector picks up my toter from my yard and returns it back to the yard once emptied. Soooooo last Thursday, my toter was emptied and was returned to my yard. Maybe I need to go to City Hall to get a WRITTEN definition of just was is meant by 'curbside' I thought it was the area the sidewalk to the street curb, but then again I could be wrong. I believe this may be hinging on 'harassment' and maybe my lawyer can clear up that definition for me! I have no intentions of tucking my tail and disappearing.
WOW Judi!! this is completely ridiculous!! Let me know if you want a ride to City Hall - I'll drop you off and pick you up so you don't have to park.
Such inefficiency!! AND THEY ARE GETTING PAID A GOOD SALARY WITH BENEFITS!! Place usually looks like a morgue. Usually only one person there because that's the way it was the last 2 times (including today) that I was down there. Makes you wonder 'whose minding the store' huh?

I think toters and recycle boxes are supposed to be taken after pickup to the back or side yard where they are not visible from the street. That would be the reason for the letter, I believe.
OK, but due to the size of my SUV and the width of my driveway, the toter cannot be moved between the house and the auto w/o taking off the side view mirror. And since collection is done before I usually get up what would you suggest? Most of the driveways on this street are narrow, and most toters are visible from the street. When we had garbage 'cans' I had a shed built to hide them, but when the bright idea of the BIG toters came about, the shed could no longer be used because the toters were too tall. When my house was painted, the color was chosen so that the color of the toters would blend in rather than contrast. I am open to suggestions.
the letter clearly indicates that the toter was "observed between the sidewalk and the curb" ..... I don't think you need to change what you're doing Judi- there are plenty of 'visible' toters on people's property throughout the SW. In fact, lots of people put them directly in front of unlicensed vehicles sitting in driveways as a means to obscure the fact that the vehicle is unlicensed (unlicensed vehicles are also a code violation).
I think that the letter you received represents yet another ERROR on the part of the City 'inspector'. The fact that you have complained about lots of garbage on your street ('real' violations) may mean your street is getting more 'attention' - i can imagine someone hearing YOUR complaint about other toters, etc on your street, getting the facts screwed up and then sending the letter to you....

Yeah I just did a right side drive around my block (just because) and O Lord Jesus, the visible toters I saw from the street! Can you just imagine the emails and photos I could send out for that!!
